=== [Page 1] === Tuesday morning On Tuesday morning the general debates on the bill concerning the state of emergency were continued in parliament. Munandir of the PNI declared that, as regards the restriction of personal rights and freedoms in times of danger, the provisional constitution provides for it if this is meant to protect the general interest. "But the curtailment of personal rights and freedoms must take place through legal channels," said the speaker, who further declared that in the realisation of similar statutory provisions one must prevent dictatorship from being confused with tactful action. Concerning the bill the speaker requested that the nature and extent of the state of emergency be limited. The speaker further pointed to the fact that the said bill corresponds little with the primary laws in the regions, as shown by the fact that the bill uses the term "pamong praja" (administration). Furthermore the speaker asked attention [Unreadable] aspect of the international war [Unreadable] in the realisation of the bill. M. Tambunan (Parkindo) stated that the laws concerning the state of emergency of a country all over the world are not accepted as sympathetic, but in emergencies the curtailment of individual rights is considered necessary; one must therefore make sacrifices for this. In the case of Indonesia it is primarily required to maintain the balance between the necessity of instituting the laws concerning the state of emergency of the country and the restriction of individual rights. And this can be achieved if one is on one's guard that the curtailment of human rights is not carried "too far." Besides, one must not stare blindly at the fact that in a democratic structure human rights stand above all and that the state has only the right to protect these rights. Concerning the appointment of a military authority, the speaker requested that the term "with the approval of the council of ministers" be changed into "on the proposal of the council of ministers the appointment shall be made by the president." Furthermore the speaker asked what has become of the status of the national security council and the coordination council for security in the bill. The speaker also wished to know what the relationship is of the daerah head vis-à-vis the local military authority and the police. According to the speaker the SOB in Nusatenggara and East Java can be withdrawn, since it is superfluous there. As 18th speaker Mr. Suprapto (Pembangunan) declared that he was worried about the fact that the government's goodwill to replace a colonial inheritance by a national law will come to nothing, since all this is being done in haste. The speaker saw in the bill the fact that the local administration is regarded as a hindrance with regard to the cooperation between state apparatus and the people in the implementation of the SOB provisions. The speaker also saw many "technical disorders" and "psychological dangers" in the bill. The speaker then suggested striking the categories "parate [readiness] and civil" state of emergency from the bill, so that only two categories of state of emergency remain. This would result in more effect in the cooperation between people and army in time of danger, as was the case in the revolutionary years. Finally the speaker requested that the implementation of the SOB provisions be entrusted only to reliable army authorities, in order thereby to prevent abuse of these rights. The speaker gave in his argument the impression that the bill still contains some articles that run counter to the provisional constitution and that these certain articles still correspond with the SOB, which dates from colonial times. Mrs. Salawati (PKI) recalled the fact that the aim of the replacement by a national law is to take to heart the interests of the people and to eradicate the enemies of the people, but that all this must not be directed against the people and damage its rights. The speaker expressed concern that the granting of power to the local administrative authorities creates the possibility of abuse of power. The speaker then pointed to many shortcomings in the bill and declared that there are many articles that oppress the people. Thus, for example, this bill does not sufficiently provide for control of the military authorities and civil officials in the implementation of the SOB. The speaker finally put forward the demand that the national SOB provisions be directed above all against the separatist elements in the regions and the henchmen of foreign investors. Amin Iskandar of the NU declared that the approval of the NU faction to deal with the bill directly in a plenary session of parliament does not yet mean that the faction is in a great hurry with this or that an inaccuracy of the NU faction with regard to the bill would be the cause of it. The opposite is precisely the case, said the speaker. The speaker also rejected the claim that the Army Chief of Staff Nasution and Premier Djuanda had "given each other orders" in the implementation of the SOB. The implementation of these national laws will have much effect on the people; it is therefore to be regretted that parliament has dealt with it superficially and that it seemed to be only a matter of ratifying the bill without more, said the speaker. He suggested dividing the state of emergency into only three categories, namely the readiness, the dangerous and the emergency. Finally the speaker put the question where the guarantees are which, in case of possible abuse of power, enable parliament to take measures against those concerned. As last speaker Arudji Kartawinata (PSII) declared that, even according to the defence laws, the whole administration of the country need not be placed in the hands of the military, although the country is in danger. Since according to the defence laws the defence of the country is a matter of people's defence, its conduct must be placed in the hands of the government. It makes no sense if the national law replacing the colonialist-tinged SOB provisions is only "a small variation" of its predecessor. Arudji was of the opinion that it is incorrect if the military authority takes over the whole administration of the country and that this does not correspond with the provisional constitution, although the country is in distress. Therefore, in the formation of the bill concerning the state of emergency of the country, account must be taken of the currently prevailing system in Indonesia, namely the principle of people's defence and that the military have only to carry out the orders of the civil power. In this bill this principle of people's defence is never touched upon. Regulations must come from a democratic body, including those of the daerahs. Also in times of need the politicians must retain their legislative rights, and these must not be placed in the hands of the military, said Arudji Kartawinata. Tuesday evening In parliament the general debates in the first round on the bill concerning the state of emergency were concluded on Tuesday evening, after three more members had spoken, namely Mawardi Noor (Masjumi), Soepardi (PKI) and Ir. Thahar Tajeb (PKI). In total 24 members had a turn to speak in the general debates in the first round. The first speaker in the Tuesday evening session, the Masjumi delegate Mawardi Noor, considered the formulation of Article 1 too vague and subjective. What does the government mean by "it is feared that there is a threat?" he argued. To which he let the answer follow that possibly the government means that it would obtain more freedom of movement. The speaker considered, however, the possibility thereby greater that conflicts would arise. The Masjumi delegate further said he had the impression that the government has put forward in the bill questions that are in fact already regulated by the basic law on the conduct of administration in the regions and by the defence law. The fact that the draft makes no mention of supervision of the implementation of the SOB provisions by the various people's representations can have as a consequence that a dictatorship develops in Indonesia. "In short," Mawardi Noor concluded his argument, "I am disturbed because the new draft shows no difference between a colonial and a national law, mainly as regards the granting of special powers to the SOB implementers." The provisions on this are, according to the speaker, merely a copy of the present SOB regulation. He therefore hoped that the government would be willing to correct these shortcomings. The communist Supardi made the recommendation that the cooperation between the civil administration, the military and the population, which at the time of the revolution proved to have yielded good results in the struggle against the enemy, should also be included in the new law on the state of emergency. He further paid tribute to the results achieved by the government and the armed forces in the implementation of the present SOB regulations. In particular he meant the results in combating corruption, which in his opinion is closely connected with foreign subversive movements in Indonesia. Soepardi further said he had received the impression that the government still thinks in the colonial atmosphere, because it regards the demands for improvement of the lot of the tanis [peasants] and the workers as "dangerous uprisings." He argued that the only possible threat could come only from the side of colonialism and not from the side of the people. The government must pay attention to this. The last speaker in the general debates in the first round, Ir. Thaher Tajeb of the PKI, declared that most of the articles in the proposed new law can, in his opinion, be called "reactionary." The provisions on the powers of the civil authority would be contrary to democracy, while the proposed powers of the military authorities would be equal to the provisions on this in the colonial law still in force at present. The new law will therefore, in his opinion, be detrimental to the workers' struggle for improvement of their lot. Nevertheless the draft gives the speaker satisfaction, because it proposes positive measures concerning the replacement of the colonial SOB ordinance. This does not mean, however, that his faction will approve the draft. He too was of the opinion that the proposed law is only a "translation" of the colonial SOB.
