Parliament yesterday morning continued the debates on the bill on the state of emergency. This session was likewise intended as the last session for the general deliberations in first round, after which the government will get the opportunity next Friday to reply to these parliamentary deliberations.
The session was attended by 150 members and was chaired by the third vice-chairman, Zainal Abidin Ahmad. On the government bench sat the minister of justice, G. A. Maengkom, and the minister of foreign affairs, Dr. Subandrio, while the secretary-general of the ministry of defence, Colonel Hidajat, represented the minister of defence. Munir of the PNI declared he could agree to the new law on the state of emergency since the constitution also provides that the rights and freedoms of the members of society may be curtailed in time of danger of war, provided with the intention of protecting the general interest and that this happens on the basis of a statutory provision. Mr. Dr. A. M. Tambunan of the Parkindo stressed in his comments on the bill that a law on the state of emergency anywhere in the world can be accepted with sympathy, since it is sometimes necessary "to sacrifice a number of our freedoms".
In Indonesia it is of the greatest importance to obtain a balance between the curtailment of personal rights and the implementation of the law on the state of emergency, said Tambunan. He finally declared he could agree to the existence of this law, insofar as the violation of human rights is not too radical.
Mr. Soeprapto of the Fraksi Pembangunan expressed his concern at the fact that the discussion of this bill is not taking place according to the usual procedure and is happening too hastily, whereby the good intention of the government to replace the colonial SOB [state of war and siege] regulation might well be undermined. Mrs. Salawati Daud of the PKI once more drew the attention of parliament and government to the position of her group that the law on the state of emergency must be intended in the first place to protect the interests of the people and not to curtail the rights due to the people.
Amin Iskandar of the NU defended the position of his group, which advocated having this bill dealt with directly in plenary session. He said that this position must by no means be seen as if his group took the law on the state of emergency less seriously. Finally he rejected the accusation that in the implementation of the present SOB regulation the army chief of staff and the premier alternately give each other instructions. Arudji Kartawinata of the PSII put forward that even in a state of emergency the whole administrative apparatus must not fall into the hands of military authority.
In a state of emergency the legislative function must remain with parliament and must not pass to military authority, said Arudji.
Afterwards it was learned that the intention to conclude the parliamentary deliberations in first round on the bill on the state of emergency with yesterday's morning session could not go ahead since a number of members who had been promised a turn to speak had not yet had the opportunity in the morning session. The discussions would therefore be continued yesterday evening.
