Volksvertegenwoordiging aanvaardt ontwerp-grondwet eenheidsstaat (People's Representation accepts draft constitution)

JN de plenaire openbare zitting van Maandagavond heeft de RISvolksvertegenwoordiging de ontwerpgrondwet van unitarisch Indonesië met 90 stemmen voor en 18 stemmen tegen aangenomen. Voor stemden de leden van de MASJUMI, PNI, PSI de Katholieken en enkele partijlozen. Tegen stemden dr. UITEENZETTING PKI In zijn toelichting op de verwerping van de ontwerp-grondwet verklaarde de heer Ngadiman Hardjosubroto namens de P.K.I.-fractie en gesteund door leden van de Partai Sosialis, dat de P.K.I. de ontwerp-grondwet heeft verworpen op grond van de volgende overwegingen: 1. er werd niet voldoende tijd gegeven aan de volksvertegenwoordiging de ontwerp-grondwet te behandelen, 2. op uitdrukkelijk verzoek van de regering kon de volksvertegenwoordiging haar recht van amendement niet gebruiken, 3. met de opname van de R.I.S.senaat en de republikeinse hoge adviesraad in de unitarische volksvertegenwoordiging wordt de samenstelling van de toekomstige volksvertegenwoordiging nog meer ondemocratisch, 4. voordat de algemene verkiezingen zijn gehouden moet de president van Indonesië door de volksvertegenwoordiging worden gekozen, 5. de functie van vice-president dient in een parlementair stelsel te worden opgeheven. Toorts is de P.K.I. van mening, dat: de unitarische republiek geen republiek is, zoals die werd geproclameerd op 17 Augustus 1945, de R.I.S. en de unitarische republiek beheerst wordt door de R.T.C., het groot-kapitaal en vreemd kapitaal nog overheersend zijn, zolang Indonesië nog gebonden is aan de R.T.C., art. 33 van de republikeinse grondwet welke is opgenomen in art. 38 van de unitarische constitutie, niet kan worden uitgevoerd, gebaseerd op de ervaringen, de constituante steeds zal worden uitgesteld er geen waarborg is, wanneer de constituante zal bijeenkomen. De P.K.I. verklaart niet medeverantwoordelijk te zijn voor de voorlopige unitarische constitutie.

PKI statement In his explanation of the rejection of the draft constitution Mr. Ngadiman Hardjosubroto declared on behalf of the P.K.I. faction and supported by members of the Partai Sosialis that the P.K.I. rejected the draft constitution on the basis of the following considerations: 1. not enough time was given to the people's representation to deal with the draft constitution, 2. at the express request of the government the people's representation could not use its right of amendment, 3. with the inclusion of the RIS senate and the Republican high advisory council in the unitary people's representation the composition of the future people's representation becomes even more undemocratic, 4. before the general elections have been held the president of Indonesia must be elected by the people's representation, 5. the function of vice-president should be abolished in a parliamentary system. Further the P.K.I. is of the opinion that: the unitary republic is not a republic such as was proclaimed on 17 August 1945, the RIS and the unitary republic are governed by the R.T.C., big capital and foreign capital are still predominant as long as Indonesia is still bound to the R.T.C., article 33 of the Republican constitution, which is included in article 38 of the unitary constitution, cannot be implemented, based on experience the constituent assembly will constantly be postponed, there is no guarantee when the constituent assembly will meet. The P.K.I. declares that it is not co-responsible for the provisional unitary constitution.
